Current contribution to the Association Sanctions Act

Read the article by former LOStA Folker Bittmann in the current issue of ZWH 2020, pp. 157-163: “An outcry! - On the speaker's draft of a law to strengthen integrity in the economy”.
The proposal of a new type of "association sanctions law", which is now also available as a government draft, provides for repressive elements similar to those in criminal law, which are to be directed specifically against economic associations as such, and not against the persons acting on their behalf. Although the new regulation is verbally oriented by the rules of law in the Code of Criminal Procedure, it breathes the spirit of times believed to have passed, in which the state divided the world into dominion and subjects. The article exemplifies this interpretation by means of specific guidelines and their effects on criminal procedure.
